Terms of Service
- § 1
Contracting party and scope
These Terms of Service ("Terms") govern the use of the Treuly service. The contracting party and provider is Treuly [legal company name], [address] ("Treuly" or "Provider"). Treuly is the seller and the issuer of invoices (merchant of record) for all contracts concluded via treuly.de. Payment processing is handled by Stripe Payments Europe Ltd. acting as a data processor; Stripe is not a contracting party of the customer.

Target audience and B2B character
Treuly is offered exclusively to businesses within the meaning of § 14 BGB (operators of shops, cafés, bakeries, salons, etc.). By concluding a paid subscription, the customer confirms that they are acting in the exercise of their commercial or independent professional activity. Consumer rights under § 13 BGB do not apply to the contractual relationship.

Contract and account
The contract is concluded when the customer registers an account. Use of Treuly on the Free plan is free of charge on a permanent basis. By creating an account, the customer confirms that they are acting for commercial purposes. The customer must keep their access credentials confidential and may only use Treuly within the limits of applicable law.

Plans, free trial and automatic renewal
Treuly offers a free plan and the paid plans Pro (€19/month or €199/year) and Ultimate (€49/month or €399/year). All prices stated are net and exclusive of statutory VAT. The applicable tax is calculated and disclosed automatically at checkout by Stripe Tax.
When entering into a paid subscription, a free trial of 14 days (monthly billing) or 60 days (yearly billing) starts. After the trial ends, the agreed price is automatically charged to the payment method provided at checkout, unless the contract has been cancelled before the trial ends.
After the trial, the subscription automatically renews at the chosen billing interval (monthly or yearly) at the then-current price until the customer cancels with effect from the end of the current billing period. Treuly will notify the customer of any price changes for the next renewal in good time so that the customer may cancel before the change takes effect.

Cancellation (cancellation-button law, § 312k BGB)
A paid subscription may be cancelled at any time via the "Cancel plan" button in the logged-in area at https://treuly.de/konto. The cancellation takes effect at the end of the current billing period; no reason needs to be given. The paid plan remains fully usable until the end of the period; thereafter the account is automatically moved to the Free plan.

Right of withdrawal
Because Treuly sells exclusively to businesses within the meaning of § 14 BGB, no statutory right of withdrawal under §§ 312g, 355 BGB applies. A voluntary goodwill arrangement may be granted on a case-by-case basis — please contact support@treuly.de. The model withdrawal form is nonetheless provided for information at /en/right-of-withdrawal.

Refunds
Refunds are initiated on request and after review via the original payment method through Stripe. Technical processing by Stripe usually takes 5–10 business days. Contact for refund requests: support@treuly.de. For in-app purchases via the Apple or Google App Store, their respective refund terms apply.
- § 8
Availability
Treuly is provided with reasonable industry-standard care. We aim for high availability but do not guarantee a specific service-level percentage unless expressly agreed in writing. Planned maintenance will be announced in advance where possible.
- § 9
Liability
The Provider is liable without limitation under statutory provisions in cases of intent and gross negligence and for injury to life, body, or health. For ordinary negligence, the Provider is liable only for the breach of material contractual obligations (cardinal duties) and limited to the contract-typical, foreseeable damage. Any further liability is excluded.
- § 10
Final provisions
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction for any disputes arising from or in connection with these Terms is Hamburg, Germany, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
If individual provisions are or become invalid, the validity of the remaining provisions is not affected.
